Terms of Sale

1. Introduction

These terms apply to the online sale of goods to consumers. Consumer purchases made online in Norway are governed principally by the Norwegian Contracts Act, the Consumer Purchases Act (forbrukerkjøpsloven), the Marketing Control Act, the Right of Withdrawal Act (angrerettloven) and the E-commerce Act. These terms do not limit the mandatory statutory rights of the consumer, but set out the parties' most important rights and obligations.

2. The parties

Seller is Kongsholmen AS, company reg. no. 919 281 936, Ryenbergveien 55, 0677 Oslo, Norway, e-mail jonas@jonassjovaag.no (referred to below as "the seller").

Buyer is the consumer who places the order (referred to below as "the buyer").

3. Prices

All prices are stated in Norwegian kroner (NOK) and include VAT where applicable. Shipping and insurance are added and shown before the order is confirmed. Artworks are unique; each work is sold once.

4. Formation of the agreement

The agreement is binding on both parties once the buyer has submitted the order and payment has been completed. The agreement is nevertheless not binding if there has been a typing or input error in the offer from the seller in the order solution or in the buyer's order, and the other party realised or should have realised that such an error existed.

5. Payment

The seller may charge for the goods from the time they are dispatched from the seller to the buyer. Payment is made via our payment provider by card or Vipps. The purchase amount is charged at the time of order.

6. Delivery

Delivery is made to the address the buyer provides at checkout. Goods are shipped carefully packaged and insured. An estimated delivery time is given at checkout. Risk for the goods passes to the buyer once the buyer, or the buyer's representative, has taken possession of the goods.

7. Right of withdrawal

The buyer generally has a 14-day right of withdrawal under the Norwegian Right of Withdrawal Act. The withdrawal period runs from the day after the goods are received. To use the right of withdrawal, the buyer must notify the seller within the deadline in an unequivocal manner (for example by e-mail). The buyer may use the standardised withdrawal form from the Norwegian Consumer Authority.

When exercising the right of withdrawal, the goods must be returned to the seller without undue delay and no later than 14 days from notice of withdrawal is given. The buyer covers the return costs. The goods must be returned in the same condition and quantity as when the buyer received them.

8. Complaints regarding defects

If the goods have a defect, the buyer must, within a reasonable time after the defect was discovered or should have been discovered, notify the seller that the defect is being invoked. The buyer has always complained in time if it happens within 2 months of the defect being discovered. A complaint may be made no later than 2 years after the buyer took over the goods. In the event of a defect, the buyer may, depending on the circumstances, withhold the purchase price, choose repair or replacement, demand a price reduction, demand cancellation of the agreement and/or claim compensation from the seller.

9. Personal data

The data controller for personal data collected is the seller. We process only the personal data necessary to complete the purchase and fulfil our obligations. The data is not shared with third parties beyond what is necessary for payment and shipping. See our privacy policy for details.

10. Dispute resolution

Complaints should be directed to the seller within a reasonable time. The parties shall attempt to resolve any disputes amicably. If this fails, the buyer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation at +47 23 400 600 or forbrukertilsynet.no. The European Commission's online dispute resolution platform may also be used, in particular for purchases from other EU/EEA countries: ec.europa.eu/odr.
